• eService is not permitted for any service that requires personal service. Any service which can be done via overnight, fax or mailed may be eServed. CRC 2.251 (a).
• In a court where eFiling is mandated, service of process must be by eServe. CRC 2.251 (c)(2). There are three exceptions to this rule: personal service is required by statute, a court orders otherwise or the case involves self-represented litigants. A party may consent to eService however. To do this either file and serve a notice of a Stipulation or a Consent to eService, or eFile any document with the court.
• You must eFile a document in each case in which you wish to consent to eService..
• Service is complete at the time of transmission.
• Anytime documents are eServed or eFiled, electronic Proofs of Service must be included with any documents being eFiled or eServed. The proof of service may be filed separately as its own document.
• eService extends the response time automatically by two court days.
• Electronic Proofs of Service need to be included along with the or both. The Proof of Service can be on pleading or on a Judicial Council form. It can also be attached to the document or submitted as its own document.
